Terms and Conditions for the Provision of Service Repair Services by Choice Group Sp. z o.o.
§1. General provisions
These terms and conditions (hereinafter the “Terms”) set out the rules and conditions for the provision of repair services by Choice Group Sp. z o.o., with its registered office at Aleja "Solidarności" 95/99 / Lu6, 00-144 Warszawa, Polska, entered in the Register of Entrepreneurs of the National Court Register under KRS number: 0001015814, NIP: 5252941236, REGON: 524294467 (hereinafter the “Service”).
Use of the Service’s services constitutes acceptance of all provisions of these Terms. The Customer is obliged to read its contents before placing an order for the performance of a service. By placing a repair order, the Customer confirms that they have read the Terms and accept their provisions.
The Service provides repair services for Apple devices and devices of other brands, including system repairs, module-level repairs, and motherboard repairs after liquid damage. These services are not covered by the manufacturer’s warranty.
The Service operates in accordance with applicable Polish law, including the Act of 30 May 2014 on Consumer Rights and the Civil Code.
The Service may provide services in cooperation with third parties, in particular for repairs requiring specialised tools or components. In such cases, the Service bears full responsibility for the quality of those services.
The Customer is obliged to create a backup copy of all data on the device before handing it over to the Service. The Service is not liable for loss of data or damage to data during repair or diagnostics, regardless of the outcome.
All parts removed/dismantled during the repair become the property of the Service and are intended for recycling in accordance with applicable environmental protection regulations.
The Customer’s personal data will be processed and stored solely for the purpose of fulfilling the order and for the period necessary to perform the service in accordance with the GDPR.
§2. Scope of services
The Service provides the following services:
repair of Apple and other brands of electronic devices;
fault diagnostics;
replacement of spare parts (original or high-quality replacement parts);
repair and replacement of motherboard components;
maintenance and diagnostic services.
In the case of repair of devices damaged by liquid, the Service does not guarantee full restoration of the device’s functionality. The Customer is informed of all risks associated with the repair of such devices. The risk of further damage during the repair of such devices rests with the Customer, unless otherwise agreed.
The Service reserves the right to refuse to repair a device if diagnosis shows that the repair is impossible or the device has irreversible damage.
The Service informs the Customer if repair of the device requires additional services or diagnostics not included in the original order. In such a case, the Customer must consent to the additional costs; otherwise, the repair will be stopped and the device returned without completion of the repair. The Service reserves the right to charge a diagnostic fee in such cases.
The Service is not liable for damage to devices occurring during transport by external courier companies. The Customer is obliged to secure the device properly before shipment.
§3. Diagnostics and repair
Before starting repair of the device, the Service performs diagnostics, the cost of which is non-refundable if the Customer withdraws from the repair. The cost of diagnostics depends on the type of device and the nature of the service.
The Service informs the Customer of all additional risks related to repair of the device, including the possibility of further damage resulting from existing defects. In the case of motherboard repairs and repairs of liquid-damaged devices, there is a risk that the device may be permanently damaged during the repair attempt, and this risk is borne by the Customer unless otherwise agreed.
The choice of spare parts (original or high-quality replacement parts) lies with the Customer, while the Service offers advice on selecting appropriate parts. The Service provides a warranty for all services and parts used in the repair, the details of which are described in §5.
The repair completion time depends on the availability of spare parts and the complexity of the defect. The stated repair time is estimated and may change depending on component availability and repair complexity.
§4. Payment terms and collection of the device
The Customer is obliged to pay the full fee for the performed service before collecting the device. The Service has the right to require an advance payment before starting the repair.
The Customer has the right to cancel the repair order at any time before the repair begins. In the event of cancellation after diagnostics has been carried out, the diagnostic cost is non-refundable.
If the device is not collected within 14 days from the date of notification that the repair has been completed, the Service has the right to charge a storage fee of PLN 10 for each day of delay. The Customer will be informed electronically or by telephone about the upcoming disposal date of the device. After 45 days, the Service has the right to dispose of the device, and the Customer will be informed in advance.
The device is released on the basis of the document confirming acceptance of the device for repair or the Customer’s identity document.
§5. Warranty
The Service provides a warranty for repaired devices:
6 months for replacement of original parts;
3 months for replacement of non-original spare parts.
The warranty covers only the replaced parts, not the entire device, and does not cover mechanical damage or damage resulting from contact with liquid.
In the case of repairs of liquid-damaged devices, the Service does not provide a warranty for the full functionality of the device. The Customer is obliged to monitor the condition of the device after repair.
Any attempts by third parties to interfere with the repaired device, breaking warranty seals, or other modifications result in the loss of the warranty.
The warranty does not cover devices that have had contact with liquid, nor cases where the repair was carried out after prior unauthorised interference with the device.
§6. Complaints
Complaints regarding performed services may be submitted in writing or electronically within 14 days from the date of collection of the device.
The Service undertakes to review the complaint within 14 business days from the date of submission. If the complaint is accepted, the Service will carry out a repeated repair or refund part of the costs if the repair was not possible.
The Service does not accept complaints for devices that were opened or repaired by third parties after repair by the Service.
§7. Liability
The Service is not liable for data stored on the device. The Customer is obliged to make a backup copy before handing over the device to the Service.
If the device is damaged as a result of repair through the fault of the Service, the Customer is entitled to a replacement device with a market value corresponding to the value of the device at the time it was accepted for repair.
The Service is not liable for damage resulting from prior interference with the device, including unauthorised repairs, liquid damage, or mechanical damage.
The Service is not liable for the lack of device functionality resulting from damage caused by liquid, even after the repair has been carried out.
The Service is not liable for delays in repair completion resulting from spare part availability issues, supplier delays, or other circumstances beyond the Service’s control.
§8. Final provisions
In matters not regulated by these Terms, the provisions of Polish law shall apply, in particular the Civil Code and the Act of 30 May 2014 on Consumer Rights.
Any disputes arising from these Terms shall be resolved by the court having jurisdiction over the Service’s principal place of business.
The Service reserves the right to amend the Terms at any time. Changes take effect upon publication on the Service website.
